The petitioner, who is sole accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 174 Cr.P.C. altered into Section 306 of IPC, in Crime No.317 of 2016 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that on 15.11.2013, the deceased, namely, Premila, got married the son of the accused at C.S.I. Church, Ranipet, Vellore. While she became two months pregnant, foetus in the womb died and aborted and thereafter she had a severe stomach pain continuously, due to which, on 08.06.2014 she committed suicide by hanging herself.
3. The learned counsel appearing for the petitioner would submit that the occurrence had taken place in the year, 2014 and the report of the RDO reveals that there was no dowry harassment. It is further submitted that in the FIR, the defacto complainant, who is the father of the deceased has not made any allegation against the petitioner. He further submitted that the petitioner is innocent and he has nothing to do with the alleged offence and she has been falsely implicated in this case.
4. The learned Government Advocate(Crl. Side) appearing for the respondent submitted that neither in the complaint nor in the
K. KALYANA S U NDARAM. J., rrg report of the RDO, there is an allegation of demand of dowry and harassment. He further submitted that some of the witnesses stated that the petitioner has not permitted the deceased to live with her husband. 5.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate No.I, Chengalpet, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. 2 5. 0 2. 2 0 1 6 rrg
