ORDER

The relief sought in this writ petition is a direction to the respondents No.2 and 3 to consider and pass suitable orders in petitioners' representation/complaint under the Maintenance and Welfare of Parents and Senior Citizens Act 2007 dated 31.03.2022, within a time frame.

2. It is stated that the petitioners are senior citizens and are the father and mother of the 4th respondent. It is further stated that the petitioners had executed a settlement deed in favour of the 4th respondent. Subsequently, alleging failure on the part of the 4th respondent to maintain and take care of them, the petitioners submitted a complaint before the 2nd respondent vide representation dated 31.03.2022 under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 seeking cancellation of the settlement deed. It is their grievance that despite the complaint being pending, the 4th respondent suppressed the said fact and instituted a suit for bare injunction in 2/5

O.S.No.51 of 2022 on the file of the District Munsif-cum-Judicial Magistrate, Vazhapady. Since the complaint / representation of the petitioners has not been disposed of till date and therefore seeks a direction for early disposal of the same.

Learned counsel for the petitioners submitted that subsequent to earlier representation of the petitioners dated 31.03.2022, the 1st petitioner has submitted another representation dated 27.02.2026, but no action has been taken by the official respondents for the aforesaid representations. Therefore, he prayed that this Court may consider the plight of the petitioners, who are senior citizens and suitable directions may be issued.

4. In response, learned counsel appearing for the official respondents submitted that petitioners' representations will be considered and orders will be passed in accordance with law. Since no adverse orders are being passed as against the 4th respondent, notice to the 4th respondent is dispensed with.

5. This Court has considered the submissions made by learned counsel on either side and perused the materials available on record. 3/5

Considering the limited prayer sought for by the petitioners and without expressing any opinion on the merits of the case, this Court directs the 3rd respondent to consider the petitioners' representations / complaint 31.03.2022 and 27.02.2026 filed under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, after affording due opportunity to the 4th respondent, and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition stands disposed of. No costs.
