O R D E R
This Criminal Original Petition has been filed to direct the respondent Police not to harass the petitioner and his family members under the guise of enquiry.
2. The learned counsel for the petitioner submitted that the petitioner is no way connected with the road accident and the respondent police is trying to implead the petitioner's name in this case on the influence of the de facto complainant and harassing the petitioner under the guise of enquiry.
3. The learned Additional Public Prosecutor would submit that initially the case was registered in respect of some other vehicle and during investigation, it was found that the petitioner's vehicle only involved in the accident.
4. Such being the position, the Investigating Officer has to follow the procedure by issuing notice to the petitioner and on such notice being issued, the petitioner shall appear before the Investigating Officer and cooperate with the investigation. If the Investigating Officer finds that if any cognizable offence is made out, he shall proceed as per law.
5. With the above directions, this Criminal Original Petition is disposed of.
