Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a writ of Mandamus, directing the 1st and 2nd respondents to consider the representation dated 04.01.2023 to regularize the service of the petitioners before filling up the vacancies as called for by the 3rd respondent and pass suitable orders or such other orders as this Hon'ble Court deem fit and proper in the circumstances of the case.

O R D E R

The instant writ petition has been filed seeking the relief of writ of Mandamus, directing the 1st and 2nd respondents to consider the representation dated 04.01.2023 to regularize the service of the petitioners before filling up the vacancies as called for by the 3rd respondent.

2. Heard the learned counsel for both sides and perused the materials available on record.

3. It is the submission of the petitioners that since 2004, all the files in the 2nd respondent's office are decided to be maintained in the computer. Pursuant to the above decision, the petitioners were appointed during 2004 - 2006 as Data Entry Operators. It is also the submission of the petitioner that the 2nd respondent has sent information on 19.01.2017 to bring the petitioners 2/5

under consolidated time scale of pay. It is the further submission of the petitioners that on 14.12.2017, through their association gave a detailed representation to the concerned Minister to consider the service rendered by the petitioners. It is also the submission that in the meanwhile on 04.01.2023, they have given a representation to the respondents for regularization, which was considered by this Court in a writ petition in WP.No.29314 of 2024 directing the respondents to consider the petitioners' representations within a period of 12 weeks. The learned counsel for the petitioners would further submit that in line with the above representation, these petitioners had also sent representation to the 2nd respondent on 04.01.2023. Therefore, seeks for a prayer that their case also has to be considered along with the other persons, who got the order in WP.No.29314 of 2024.

The learned Additional Government Pleader would submit that in pursuance of the order passed in WP.No.29314 of 2024, they have considered the representation of the individuals and they have rejected their claim. Therefore, there is no purpose in further directing the respondents to consider the representation of the petitioners.

5. However, the factum of rejection was stoutly objected by the learned counsel for the petitioners.

In view of such disputed fact and upon the limited prayer sought for by the petitioners to consider their representation, this Court without going into the merits of the matter, deems it appropriate to direct the 2nd respondent to consider the representation dated 04.01.2023 on it's own merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

7. In the result, this Writ Petition is disposed of with the above directions. There shall be no order as to costs. Consequently, connected WMP is also closed.
