This Civil Revision Petition has been preferred seeking direction for the speedy disposal of O.S.No.135 of 2021 pending on the file of the Principal Subordinate Court, Chengalpet.
2. The revision petitioner is the plaintiff, who has filed the suit for injunction. The grievance of the petitioner is that the learned trial Judge has repeatedly adjourned the matter for filing of written statements of the defendants and hence, it is stagnated.
3. On perusal of the records, it is seen that reasonable opportunity was given to the defendants for filing the written statement. The defendants at one point of time was set ex-parte and later they filed a petition for setting aside the ex-parte order. Despite that, the defendants did not file the written statements. Page 2 / 4
4. The learned trial Judge is aware of the time limit for filing written statements. If the defendants did not file the written statements within the prescribed time, the learned trial Judge has to take the original suit in O.S.No.135 of 2021 to the next stage. However, the case is of the year 2021 and hence, no time limit can be fixed for disposing the case. In the interest of justice, it will be sufficient, if the learned trial Judge gives shorter adjournments and expedite the trial as early as possible.
5. In the result, the Civil Revision Petition is disposed of and the learned Principal Sub Judge, Chengalpet is directed to dispose the Suit in O.S.No.135 of 2021 as expeditiously as possible. No costs.
