By consent, the writ petition is taken up for final disposal. 2.The petitioner has filed this writ petition, seeking a direction to the respondents to release the Heavy Goods Vehicle 107 bearing Registration No.TN 20 BA 3339 which was seized by the Sub Inspector of Police, Salavakkam on 20.12.2015 by considering the representation dated 23.12.2015.
3.According to the petitioner, he is the owner of the Heavy Goods Vehicle 107 bearing Registration No.TN 20 BA 3339. When the petitioner transported sand in the vehicle in question, it was seized by the Sub Inspector of Police, Salavakkam for want of valid document or permission obtained from the Government. Subsequently, a case was registered under Section 21 of the Mines and Minerals Act and handed it over to the second respondent. Therefore, the petitioner made a representation dated 23.12.2015 https://hcservices.ecourts.gov.in/hcservices/
to the respondents for release of the vehicle, but the same is yet to be disposed of. Hence, the petitioner is before this Court. 4.Heard the learned counsel for the petitioner and the learned Special Government Pleader, who took notice for the respondents.
5.Considering the limited nature of the relief sought for herein, without going into the merits of the case, the respondents are directed to consider the petitioner's representation dated 23.12.2015 for release of the vehicle in question and pass appropriate orders on merits and in accordance with law, within 10 days from today.
