2. It is clear from the complaint given by the petitioner that her husband solemnized second marriage and that is evident from the settlement deed executed by the petitioner's husband. As the offences punishable under Section 494 IPC is a non-congnizable offence, it is open to the petitioner to file a private complaint and prove the second marriage.

3. The Criminal Original Petition is dismissed with the above observation.
