Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to pass an order directing the 2nd respondent to furnish the original entire enquiry report together with depositions and documents pertaining to the proceedings in REF NO.222/2/A2/2014 DT 15/09/2014 of the 2nd respondent pursuant to the complaint dt 25/11/2013 and further direction directing the respondents 2 to 5 to refer before the District Social Welfare Officer for Domestice Violence Office of the District social Welfare Board Chennai having the petitioners residential jurisdiction and to investigate the case of the petitioner under Domestice Violence Act or any other order or directions as this Honble court.

ORDER

The petitioner has come up with a prayer to pass an order directing the second respondent to furnish the original entire enquiry report together with depositions and documents pertaining to the proceedings in Ref No.222/2/A2/2014 dated 15-09-2014 of the second respondent pursuant to the complaint dated 25-11-2013 and further direction directing the respondents 2 to 5 to refer before the District Social Welfare Officer for Domestice Violence Office of the District social Welfare Board, Chennai having the petitioner's residential jurisdiction and to investigate the case of the petitioner under Domestice Violence Act. It is seen that earlier the same petitioner had filed Crl.O.P.No.28138 of 2014 for a direction to register her complaint dated 25-11-2013 given to the Police. This Court on 15-10-2014 passed the following order:

The learned Additional Public Prosecutor would submit that the complaint was referred to the District Social Welfare Officer, Thiruvallur who in turn has submitted his report in Roc.No.222/A2/2014 dated 16.08.2014 wherein she has stated that the conflict between the parties is due to adjustment difficulties, caste differences and money issues. Therefore, it has been decided not to register any case.

Having regard to the said detailed report submitted by the District Social Welfare Officer, Thiruvallur, no direction as sought for by the petitioner can be granted. The petition is dismissed. However, it is open for the petitioner to work out the remedy in the manner known to law."

Surprisingly, in this petition there is no whisper about the order passed by this Court in Crl.O.P.No.28138 of 2014, on 1510-2014. The prayer in this petition is for a direction to give an enquiry report and deposition from the District Social Welfare Officer.

Mrs. MG. Karuna Bai, Sub-Inspector of Police, W33, AWPS, Madawaram is present and the learned Additional Public Prosecutor, on instructions, from the said Police Officer submits that the petitioner has been furnished with all the records by the concerned Social Welfare Officer. Therefore, the prayer as sought for in this petition has already been complied with.

In view of the aforesaid submission, no further orders are necessary and the petition is closed.
