Criminal Original Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioners on bail in crime No.67 of 2022 on the file of the respondent police.

ORDER

The petitioners, who were arrested and remanded to judicial custody on 28.05.2022 for the offence punishable under Sections 454, 457 & 380 of IPC in crime No.67 of 2022 on the file of the respondent police, seek bail.

2. It is the case of the prosecution that when the defacto complainant was not at home, the accused persons broke open the window and took away gold and silver idols worth Rs.20,27,500/- and cash of Rs.3,00,000/- kept in locker. Hence, the case.

3. The learned counsel appearing for the petitioners would submit that the petitioners have not involved in the offence as alleged by the prosecution. He would further submit that the property

was seized from A1 and on his confession only, the petitioners have been arrayed as accused. Hence, he prays to grant bail to the petitioners.

4.The learned Additional Public Prosecutor appearing for the respondent police submitted that there are totally four accused, in which the petitioners are arrayed as A2 and A3. He would further submit that entire property has been recovered and the petitioners have no previous cases. However, he vehemently opposed to grant bail to the petitioners.

5. Considering the above facts and circumstances of the case and also the period of incarceration by the petitioners, this Court is inclined to grant bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail on their executing a separate bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two blood related sureties, each for a like sum to the satisfaction of the Judicial Magistrate-II, Erode and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioners shall stay at Melmaruvathur and report before the Inspector of Police, Melmaruvathur Police Station, Melmaruvathur daily at 10.30 a.m. and 05.30 p.m.

[c] the petitioners shall not abscond either during investigation or trial.

[d] the petitioners shall not tamper with evidence or witness either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter abscond, a fresh FIR can be registered under Section 229A IPC.
