The petitioner, who was arrested and remanded to judicial custody on 09.04.2022 for the offences punishable under Sections 294(b), 324, 448, 307 and 506(ii) of IPC in crime No.531 of 2018 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with some others abused and assaulted the defacto complainant in the year 2018. Originally, the petitioner was arrested and released on bail in some other crime number, but the respondent police arrested the petitioner in this case by way of PT warrant on 09.04.2022.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he seeks for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner was produced on PT warrant on 09.04.2022. He would further submit that the petitioner has 21 previous cases. Hence, he vehemently

opposed to grant bail to the petitioner.

5. It is seen that the petitioner was arrested and remanded to judicial custody on PT warrant. Though, the crime is of the year 2018, the petitioner absconded and he was arrested only on PT warrant. Further, the petitioner has so far involved in 21 cases and as such, he is a habitual offender. Therefore, this court is not inclined to grant bail to the petitioner.

6. Accordingly, the criminal original petition is dismissed. 05.07.2022 lok
