Heard both sides.

2. The learned counsel for the petitioner taking this court through the allegations made by the victim child would submit that the allegations are vague in nature and from the very fact that the child has traveled in the bus without raising any alarm would raise a suspicion in the case of the prosecution. He would further submit that the petitioner is prison for almost three years. Therefore, he would seek for suspension of sentence.

3. Per contra, the learned Government Advocate (Criminal Side) would submit that this is a case where the victim child was forcibly taken by the petitioner and was sexually abused and the child was hardly 9 years old.

4. On a perusal of the nature of the allegations and the injuries to the child, I am of the view that this is not a fit case for the grant of suspension of sentence and bail to the petitioner pending criminal appeal.
