(Crime No.265 of 2019) PRAYER: Criminal Original Petition is filed under Section 438 of Criminal Procedure Code to enlarge the petitioner/accused on bail in the event of his arrest in Crime No.265 of 2019 on the file of the respondent police.

ORDER
(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 342, 324, 397, 364-A and 506(2) of IPC in Crime .No.265 of 2019, seeks anticipatory bail.
2.The case of the prosecution as per the defacto complainant Mohammed Thahir is that he was doing real estate business along with one Ramakrishnan and Durairaj and he had some problems in his business. Therefore, he had approached one Johnson Elango, the first accused herein and that the said Jonson Elango assured the defacto him that he would solve his problems. Thereafter, on 10.05.2020 at about 8:00 a.m., the Johnson Elango/A1 had called the defcafto complainant over phone and told him to meet him at Ezhilagam. Accordingly, the defacto complainant had gone to the said place along with one Muniraj / A2 by his car and met him. Thereafter, A1 also got into the car and taken them to a newly constructed apartment at Thuraipakkam, Manthoppu Pillaiyar Koil Street wherein,
the 1st and 2nd accused along with 3 unknown persons, threatened the defacto complainant at gun point and demanded a sum of Rs.1 Crore from him and also attacked him with backside of the pistol, iron rod and electric cables pursuant to which, the defacto complainant made a call to his wife and told her to bring the demanded amount to Anna Square. Accordingly, when the wife of the defacto complainant had brought the money, the accused taken away the amount along with his money purse, ATM Card and the contract documents made between Ramakrishnan and Durairaj and escaped from the scene of occurrence. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that the name of the petitioner is not found place in the F.I.R. However, he has been falsely implicated in this case based on the confession of A1. Hence, he prays for grant of anticipatory bail. 4.The learned Government Advocate (Crl. Side) appearing for the respondent police would vehemently oppose stating that the petitioner along with other accused kidnapped the defacto complainant and obtained a sum of Rs.1 Crore as ransom from the wife of the defacto complainant. He would further submit that so far, A1 has been arrested from whom a sum of Rs.20.40 lakhs has been recovered and the other accused are yet to be arrested. He would further submit the petitioner is a habitual offender against whom there are twenty two previous cases pending as detailed below; S.No .

5. Taking into account the nature of offence and the fact that the petitioner is a habitual offender against whom there are several cases pending and only A1 has been arrested so far and the other accused are still absconding, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
