Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents police to give adequate police protection to the petitioner on the basis of the complaint made by the petitioner on 26.05.2019 by providing PSO with Uniform.

ORDER

This petition has been filed seeking for police protection.

2. The learned counsel for the petitioner submitted that the petitioner belongs to an organisation affiliated to a political party. The petitioner was facing threat from antisocial elements and therefore he has sought for police protection before the 1st respondent. The 1st respondent after taking into consideration the threat perspective, by his proceeding dated 02.07.2018 provided police protection for a period of three months and thereafter the security cover was revoked.

3. The petitioner made a representation to the 1st respondent on 26.05.2019 explaining about the continuing threat on the life of the petitioner and requested the 1st respondent to https://hcservices.ecourts.gov.in/hcservices/

provide police protection. Since the same has not been considered, the present petition has been filed.

4. The 2nd respondent has filed a counter before this Court. 5.

Heard the learned Additional Public Prosecutor appearing on behalf of the respondent police.

6. Taking into consideration the facts and circumstances of the case, the 1st respondent is directed to conduct an enquiry on the representation made by the petitioner on 26.05.2019 and assess the threat perspective and thereafter take a decision as to whether police protection must be given to the petitioner. This exercise shall be completed within a period of three weeks from the date of receipt of copy of this order.

7. This Criminal Original Petition is disposed of with the above direction.
