Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondents to consider and pass orders on the petitioners representation dated 14/08/2015 and appoint the petitioner in the suitable post as per the Public Notifications issued in the Daily Thanthi Paper dated 14/08/2015 and 15/09/2015.

By consent, the writ petition is taken up for final disposal.

The petitioner claims that he is having a valid driving licence to drive light motor vehicles as well as the heavy duty vehicle and he was given appointment in the Tamil Nadu Agro Engineering Service Cooperative Federation Limited on 06.10.1995 and his services were regularised on 15.04.1999 and however, vide G.O.Ms.No.395, Agriculture (A.E.II) Department dated 27.11.2002, Tamil Nadu Agro Engineering Service Co-operative Federation Limited has been ordered to be wound up and accordingly, the petitioner was issued with retrenchment notice on

28.10.2003 and vide G.O.(2D) No.78, Animal Husbandry and Fisheries (K.P-7) Department dated 11.11.2003, some of the employees of the AGROFED was also absorbed under their services and though the petitioner has been similarly placed, he has been left out and in this regard, repeatedly submitted representations to the various officials and since it failed to invoke any kind of response, came forward to file this writ petition.

The learned counsel appearing for the petitioner would submit that the second respondent has issued notification dated 14.08.2015 calling for recruitment to certain post which include Office Assistant and the petitioner has also submitted his application dated 20.08.2015 followed by reminder dated 24.08.2015 to consider his claim for appointment to any one of the said post according to his qualification and suitably by taking into consideration G.O.(2D) No.78 of the same department dated 11.11.2003 and since no order has been passed, the petitioner is constrained to file this writ petition.

4. This Court also heard the submissions of Mr.S.Gunasekaran, learned Government Advocate who accepts notice on behalf of the respondents.

5. Though the petitioner prayed for a larger relief, this Court in the light of the above facts and circumstances, directs the respondents 1 and 2 to consider and dispose of the representation dated 24.08.2015 submitted by the petitioner on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly.
