This writ petition has been filed seeking issuance of a writ of mandamus directing first respondent to dispose of appeal made by petitioner on 22.11.2024 wherein the petitioner has sought inclusion of his name in Patta Nos.571 & 1438.
2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to respondents 3 & 4 is dispensed with.
3. The case of the petitioner is that the petitioner having properties comprised in S.F.No.59/1 measuring an extent of 18 cents situated at Kattunemilli Village, Ulundurpettai Taluk and that patta also stands in his name vide Patta Nos.571 & 1438. The main grievance of
petitioner is that his name was removed from Patta Nos.571 & 1438 without any notice or any information. Petitioner thus submitted a representation on 23.12.2022 before the Tahsildar, seeking inclusion of his name in the above patta numbers. But the Tahsildar, without conducting any enquiry, rejected petitioner's representation by order dated 02.08.2024. Hence, petitioner preferred an appeal in Appeal No.2620 of 2024 dated 22.11.2024 before the Revenue Divisional Officer. But till date, the said appeal is kept pending. Thus petitioner made a representation on 17.03.2025 before first respondent to dispose the appeal. Since the same was not considered, the present writ petition has been filed before this Court.
4. At the outset, it is submitted by learned Government Advocate for first respondent that he may be granted twelve weeks time to dispose the appeal, which was agreed to by learned counsel for petitioner.
5. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to
first respondent to deal with the appeal made by the petitioner on 22.11.2024 on its own merits and in accordance with law within a period of twelve weeks from the date of uploading of the web copy without waiting for the receipt of certified copy, after putting petitioner, respondents 2 & 3 and other interested parties including rival claimants if any, on notice. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to first respondent to consider the appeal on its own merits and in accordance with law.
6. Accordingly, this Writ Petition is disposed of with the above direction. However, there shall be no order as to costs. 23.06.2025 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No vji
