A.No.2652 of 2024 in O.P.No.278 of 1948 THE ACTING CHIEF JUSTICE The Administrator General and Official Trustee of Tamil Nadu has filed the instant application seeking permission of this Court to donate a sum of Rs.1,96,480/- (Rupees One Lakh Ninety-Six Thousand Four Hundred and Eighty Only) to Headmistress, Lady Willingdon Government Model Girls Higher Secondary School, Triplicane, Chennai for providing uniform to the classes 9th to 12th (9th Std - 40 students, 10th Std - 32 students, 11th Std - 70 students and 12th Std - 70 students), who are 212 in total and to incur the said expenses from and out of the accumulated fund of the Trust Estate of C.Kandasamy Naidu of that relates to 2019 - 2020.

In support of the Judge's Summons, the Administrator General and Official Trustee of Tamil Nadu (AG & OT) has filed his report dated, 03.06.2024, which reads thus:- The AG & OT submits that the office of the Administrator General and Official Trustee of Tamil Nadu has been administering more than 150 Trust Estates. There are properties to Trust Estates and rental income derived from them are invested in fixed deposits. Out of the rental and interest income, the O/o AG & OT has been doing charities as directed by the testator such as maintenance to the beneficiaries, scholarship to the students, salary to estate staff, paying statutory charges to government, paying income tax and meeting other necessary expenses. Apart from that, as per the orders of the Hon'ble High Court donation by way of money, things, articles and medical equipment's etc., have been made to various NGOs and other religious and non-religious institutions based on their request.

It is submitted that the Trust Estate of C.Kandasamy Naidu is one among the trust estates which is vested with this office as per the last Will of the testator dated 21.05.1948 [D1], and as per the letters of administration of the Hon'ble High Court in O.P.No.278 of 1948 Dated 05.10.1948.The Trust Estate of C. Naidu has various properties and fixed deposits. Out of the income generated from them charities are being done as per the Will of the Testator and the orders of this Hon'ble Court.

03.The Official Trustee further submits that one Mrs. R. Hema Priya, Headmistress of Lady Willingdon Government Model Girls Hr. Sec. School. Triplicane, Chennai - 05 has given a letter and quotation dated 01.05.2024[D2], requesting donation for providing Uniform for the classes 9th to 12th (9th Std - 40 students, 10th Std - 32 students, 11th Std - 70 students and 12th Std - 70 students). Presently, free uniforms are given by the government to students only up to 8th grade. Further, she mentioned that it would be tremendously helpful to the students and will increase enrollment rate in the school.

04. The Official Trustee further submits that Lady Willingdon Government Model Girls Hr. Sec. School. Triplicane, Chennai is an exclusive school for Girl children and most of the students come from poor and downtrodden fisher man families. The school is even conducting special classes to the students of class X to XII in order to help them achieving good score in the public exams. The Head Mistress of Lady Willingdon Government Model Girls Hr. Sec. School. Triplicane, Chennai - 05 has submitted the quotations as follows:- Sl.No.

Rs.1,96,480/- Mr.Sajjan & Sons, 77/1 & 2, Godown Street, Chennai - 01 Rs.2,15,830/- 05.The Official Trustee further submits that already the office of the AG & OT with the order of this Hon'ble High Court donated Rs.4,61,600/- (Rupees Four Lakh Sixty-One Thousand and Six Hundred Only) for providing lunch and snacks to poor students who appeared for their public examination. The above donation had benefited to the poor girl students in cracking good scores in the public examination. The Head Mistress had mentioned that in his request letter itself. 06.The Official Trustee further submits that the Head Mistress of the above Government School had requested donation of Rs.

1,96,480/- (Rupees One Lakh Ninety-Six Thousand Four Hundred and Eighty Only) for providing Uniform for the classes 9th to 12th (9th Std - 40 students, 10th Std - 32 students, 11th Std - 70 students and 12th Std - 70 students). Presently, free uniforms are given by the Government to students only up to 8th grade. Further, she mentioned that it would be tremendously helpful to the students and in increasing the enrollment rate in the school.

07. The Official Trustee further submits that the objectives of the above trust estate namely C. Kandasamy Naidu has a provision to make donations for the education of the poor students. In fact from the trust estate, already we are making similar donations with the order of this Hon'ble Court. 08.The Official Trustee further submits that, the "C. Kandasamy Naidu" is the one of the major trustestate under our administration. As per the trust accounts the trust estate is having sufficient fund as Accumulated Fund that relate to the year of 2019 - 2020. By making the above donation the trust estate will not be put in financial trouble to meet its periodical and committed expenses.

3. Heard the submissions made by the AG & OT and also perused the materials available on record.

4. Having accepted the report dated 03.06.2024 filed by the AG & OT, this application stands ordered as prayed for.
