Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the third respondent to take action as per the order of the first respondent dated 7.12.2020 to prevent the encroachment of existing water canal in Survey No.453, 509/2, 510/2 in Gudalur Village, Coimbatore North Taluk. ORDER
(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.B.Nedunchezhiyan, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 3.
2. Learned State Government Pleader submits that field inspection was conducted and no encroachment was found. There are only standing trees.
3. The writ petition is filed on apprehension. We cannot
entertain the writ petition merely based on apprehension. In view of the above, the writ petition is dismissed. There will be no order as to costs.
