This Civil Miscellaneous Petition has been filed seekisng to condone the delay of 268 days in filing the above Civil Miscellaneous Appeal.

2. Mrs.R.Sreevidhya, learned counsel appearing for 2nd respondent submitted that the 2nd respondent opposed the petition seeking for condoning the delay of 268 days.

3. Considering the facts and circumstances, and being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay in filing the appeal is condoned and the petition is ordered on condition that, in the event of appeal is being allowed, the appellant is not entitled for interest for the default period. Registry is directed to number the appeal, if the papers are otherwise in order and also directed to print the name of Mrs.R.Sree Vidhya, learned counsel appearing for 2nd respondent in the cause list.
