All these applications have been filed to condone the delay ranging from 280 to 369 days in filing the memo by each one of the defendants to adopt the written statement already filed by the 2nd and 11th defendants. 2.It is seen from a perusal of the affidavits that the suit summons had been received on various dates by each one of the defendants. It had been further stated that the 2nd and 11th defendants had filed a detailed written statement. It had also been stated that the memo adopting the written statement had actually been filed, but could not be identified in the Court bundle and thereafter, it had been returned for want of signature. In correcting that particular mistake and in re-presenting there has been a delay ranging from 280 to 369 days. Even though a common order is passed in all these applications, since the defendants should be given with an opportunity to contest the claims of the plaintiff, I would condone the delay in filing the adoption memo by each one of the defendants.
