ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 364 and 302 of I.P.C. r/w.147, 364, 302 & 201 of I.P.C. in Crime No.34 of 2021, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 16.01.2021, when the deceased, namely, Logidoss @ Muniyappan was standing in Puthureddiur Road, a Car driven by A1 was came in a rash and negligent manner along with A2 to A4. Hence, the deceased questioned A1 to A4. Immediately, the accused kidnapped the deceased and went to Muthanur Village and all the accused have attacked the deceased. As a result, the deceased got grievous injuries and died in his house after narrating the entire facts to his wife. Hence, the wife of the deceased lodged a complaint before the respondent police.
3. The learned counsel appearing for the petitioner submitted that the petitioners have not committed any offences as alleged by the prosecution and they have been falsely implicated in this case. https://hcservices.ecourts.gov.in/hcservices/
Hence, the learned counsel prays for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl.Side) submitted that the petitioners were brutally attacked the defacto complainant's husband and caused grievous injuries to him. Due to which, the defacto complainant's husband died. Hence, he vehemently opposed the grant of anticipatory bail to the petitioners.
5. Considering the facts and circumstances of the case and the gravity of offence committed by the accused persons, this Court is not inclined to grant anticipatory bail to the petitioners.
