PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the second respondent herein to register the sale deed bearing pending Doc.No.P/Kundrathur/862/2024 dated 04.12.2024 executed by one Bhagyalakshmi to and in favour of the petitioner herein and release the same after due registration in accordance with law within a time frame as may be fixed by this Court and pass orders. 1/5

ORDER
The present writ petition is filed praying for a writ of mandamus to direct the second respondent to register the sale deed bearing pending Doc.No.P/Kundrathur/862/2024 dated 04.12.2024 executed by one Bhagyalakshmi to and in favour of the petitioner and release the same after due registration, in accordance with law, within a time frame as may be fixed by this Court.

It is submitted by the learned counsel for the petitioner that the petitioner proposed to purchase the property, comprised in Survey Nos.158 and 159 measuring an extent of 2400 sq.ft, situated at Sri Karumariamman Nagar, Extension, in Kollacherry Village, Sriperumbudur Taluk, Kancheepuram District from one Bhagyalakshmi (sister of the petitioner). Accordingly, a sale deed was presented before the second respondent on 04.12.2024 for registration. The petitioner has paid the sale consideration and stamp duty. However, the sale deed document is pending before the second respondent in 2/5
Doc.No.P/Kundrathur/862/2024. Hence, the petitioner has filed the present writ petition.

At the outset, it was submitted by the learned Special Government Pleader that the sale deed Doc.No.P/Kundrathur/862/2024, dated 04.12.2024, would be registered, if it is otherwise in order, within a time frame to be fixed by this Court. If for any reason, the Sub Registrar is of the view that the registration ought to be refused, he would do so after assigning reasons, which was agreed to by the learned counsel for petitioner

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the second respondent to register the sale deed dated 04.12.2024, if it is otherwise in order, in accordance with law, within a period of one week, from the date of uploading of the web copy without waiting for the receipt of certified copy. If for any reason, the respondent refuses to register the sale deed, he shall assign reasons in the refusal slip, which was agreed to by both counsel for petitioner as well as respondents. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance 3/5
with law.
5. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
