This application has been filed by Mrs.Suneetha Suresh, claiming to be a new Trustee of the public Trust, which is the subject matter of the dispute.

A counter affidavit has been filed by the respondents/plaintiffs stating that the applicant was inducted as a Trustee only recently and earlier, she was a tenant in respect of one of the trust properties and therefore, she is not entitled to implead herself as a party defendant in the suit. 3.

This Court is of the considered view that admittedly, being a Trustee, no prejudice will be caused to any other parties, if the applicant is impleaded as a party defendant in the suit. With regard to the contentions made by the respondents/plaintiff that earlier she was a lessee under the public Trust and only recently, she was elected as a Trustee and therefore, she is not entitled to be impleaded as a party defendant in the suit is concerned, the same can be adjudicated, while the suit is disposed of on merits and in accordance with law.

Therefore, without prejudice to the rights and contentions of the respondents/plaintiffs with regard to the merits of the claim made by Mrs.Suneetha Suresh, this application for impleadment filed by her in A.No.3109 of 2021 is allowed. The respondents/plaintiffs are directed to carry out the amendment in the suit.
