This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 09.04.2024, seeking bail in Crime No.289 of 2024 registered under 174 Cr.P.C and later altered for the offences punishable under Sections 302, 201, 202 r/w 120B of IPC.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has nothing to do with the alleged offence and the petitioner is suffering incarceration from 09.04.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police submitted initially, based on the complaint given by the Village Administrative Officer of Ernavoor Village stating that a dead body was buried under the concrete stones on the backside of the Annai Sivagami Nagar playground, the case was registered under Section 174 Cr.P.C. During the course of investigation, it came to light that the decomposed body was identified as one Karthick and he was murdered by the first accused during the quarrel that arose between them while they were drinking liquor together. Thereafter, the first accused had taken the photograph of the dead body and sent the same to accused 2 and 3 and then, the accused conspired together and screened the offence.

4. He further submitted that the petitioner herein is the person who had accompanied and assisted the first accused in screening the offence. He also submitted that this case needs a detailed investigation and if the petitioner is released on bail at this stage, there is a possibility of him absconding and not available for further investigation.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and considering the nature and gravity of the offence committed by the accused and taking note of the fact that this case needs a detailed investigation, this Court is not inclined to grant bail to the petitioner.
