Upon despatch of notice pursuant to order dated 29.04.2022, the applicant filed an affidavit of service indicating that notices were returned as unserved. Therefore, the applicant was directed to ascertain the current address and also serve notice on counsel who appeared in connected proceedings before the Trademark Registry. At the next hearing on 24.06.2022, learned counsel for the applicant stated that the address specified in the plaint is also the address indicated in the records of the Trademarks Registry and that the applicant is unable to identify any other address. Pursuant to permission granted on that date, the present application is presented.

2. On examining the reasons set out in the affidavit, this application is liable to be allowed. Accordingly, the applicant is directed to effect service by affixing notice on the Court notice Board and the last known address. In addition, service by publication in one issue of the English daily TIMES OF INDIA circulating in GURGAON and one issue of Hindi daily DAINIK BASKAR circulating in the city of GURGAON shall be effected indicating the next date of hearing as 22.07.2022.

3. List the matter on 22.07.2022.
