This petition is filed to condone the delay of 239 days in filing the above appeal against the judgment and decree dated 06.07.2019 made in M.C.O.P.No.183 of 2016 on the file of the Additional District Court (Motor Accident Claims Tribunal), Namakkal.

2.The learned counsel for the petitioners submitted that the 1st respondent remained exparte before the Tribunal and hence, notice to the 1st respondent may be dispensed with.

3.In view of the same, notice to the 1st respondent is dispensed with.

4.Mrs.R.Srividhya, learned counsel appearing for the 2nd respondentInsurance Company takes notice for the 2nd respondent and submitted that the 2nd respondent has no objection in ordering this petition.

5.Recording the no objection submitted by the learned counsel appearing for the 2nd respondent and being satisfied with the reasons stated in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and delay is condoned.
