O R D E R

The petitioner, who apprehends arrest for the alleged offences under Sections 318(4) of BNSS and 66D of IT Act, in Crime No.324 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the de-facto complainant was induced to participate in online share marketing and he was added in a wats app group led by one Anandaselva claiming himself to be trading analyst and one Mrs.Shruthi Sharma who is Assistant of said Anandaselva and Monjkumar Agarwal from customer service have induced the complainant to purchase share in the share market based on their instruction and tips and accordingly, it was alleged that the complainant has parted several amounts on the false promise of offering 50 to 100% profit and subsequently, none the aforesaid persons did not allow the complainant to withdraw the funds in his account. Hence the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution. The learned counsel further submitted that he was not a named accused and there is no specific allegation against the petitioner. However, on instructions, the learned counsel further submits that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court 2/4

and hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are totally three accused in this case, in which the petitioner is arrayed as A3 and he further reiterated the prosecution case. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. On perusal of the records would reveal that the petitioner is the main master mind behind every one and he had only operated the account of A1 and A2. Therefore, the custodial interrogation of the petitioner is very much required in this case.

7. In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner.

8. Accordingly, this Criminal Original Petition is dismissed. 23.06.2025 uma 3/4
