Criminal Original Petition has been filed under Section 482 of BNSS 2023, to enlarge the petitioners on bail in the event of arrest by the respondent police concerned in Crime No.04 of 2025 on the pending file of the Inspector of Police, CCD-II, Villupuram Police Station, Villupuram District.

O R D E R

The petitioner/A5, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 318(4) of Bharatiya Nyaya Sanhita (BNS) 2023, and Section 66D of Information of Technology Act in Crime No.4 of 2025 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner was acted as an Agent and Manager for A1 company. This petitioner was employed under A1 company and collected deposits on behalf of the A1 company and he has not cheated any person.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl.Side) submitted that this petitioner is an agent of A1 and collected Rs.8lakhs from the public. An 2/6

the investigation is pending.

5. Considering the fact that co-accused has already been granted bail and the petitioner appears to have been an agent for collection, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner is directed to deposit a sum of Rs.1,00,000/- [Rupees One Lakh Only] to the credit of Crime No.4 of 2025 before the trial Court, on such deposit and production of proof, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on or before 04.09.2025, before the learned Judicial Magistrate No.1, Villupuram, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:

(a)If the petitioner fails to surrender before the concerned Magistrate on or before 04.09.2025, this order shall stand 3/6

automatically cancelled;

(b)The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;

(c)The petitioner shall report before the respondent police daily at 10.30 a.m., unti further orders.

(d)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];

(e)If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
