..Respondents Writ Petition filed under Article 226 of Constitution of India seeking for issuance of Writ of Mandamus directing the respondents to refund
the Rs.20,00,000/- payable to the petitioner towards refundable security deposit in the account of the Petitioner Solar Power Plant HTSC.No.069534460040 and pass appropriate orders as this Court may deem fit and proper in the facts and circumstances of the case.

ORDER
This Writ Petition has been filed seeking a direction to the respondents to refund a sum of Rs.20,00,000/- payable to the petitioner towards refundable security deposit in the account of the Petitioner Solar Power Plant HTSC.No.069534460040.
2.Heard the learned counsel appearing on either side. With the consent of both sides, this writ petition is taken up for hearing at the admission stage itself. 3.It is the case of the petitioner that the petitioners made application to the respondents for establishment of MW Solar Power Plant under preferential tariff scheme for captive consumption as per TNERC's Solar Order No.5/2018 dated 28.03.2018 and paid a total sum of Rs.20 Lakhs, towards refundable security deposit. Even after commissioning of the said solar power plant which was also certified by the respondents vide letter dated 15.04.2024, the refundable amount
was not paid by the respondents, for which the petitioner made representation to the 2nd respondent, however, there is no response. Hence, this writ petitions has been filed.
4.The learned counsel for the petitioner submitted that this Court in an identical issue in W.P.No.46508 of 2025 on 27.11.2025 had passed an order, wherein, it has directed the first respondent to refund the eligible amount to the petitioner therein with appropriate interest as provided in the contract, if there is no legal impediment, within a period of six weeks and prayed to extend the same benefits to the petitioners herein.

Considering the facts and circumstances of the case and in the light of the order passed by this Court as stated supra, there shall be a direction to the first respondent to refund the eligible amount payable to the petitioner with appropriate interest as provided in the Contract, if there is no other legal impediment in disbursing the same to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
