Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for a writ of mandamus directing the 2nd respondent to transfer the petitioner as Nursing Superintendent Grade II, in the Mahatma Gandhi Memorial Government Hospital, Trichy, on the ensuing vacancy arises in the month of October 2015.

ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner who is working as Nursing Superintendent, Grade-II in the Government Headquarters Hospital, Namakkal, prayed for transfer to Mahatma Gandhi Government Memorial Medical College Hospital at Trichy. In this regard, she filed WP. No.7103/2015 before this Court and vide order dated 29.04.2015, this Court has directed the Director of Medical and Rural Health Services, Chennai, to consider the petitioner's representation on merits and in accordance with law after affording an opportunity of personal hearing to the petitioner. The 1st respondent, vide notice dated 11.09.2015, called for the petitioner to appear before him for personal hearing on 16.09.2015 at 11.00 a.m. without https://hcservices.ecourts.gov.in/hcservices/

fail. The petitioner has also appeared ; however, the result of the same is not made known to him. The petitioner in the affidavit filed in support of this writ petition has stated that one Parimala has already been accommodated in Mahatma Gandhi Government Memorial Medical College Hospital and there is one more vacancy also arose in the very same hospital and that her claim may be considered.

This Court heard the submissions of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents.

Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the same, directs the 1st respondent to pass orders on the request made by the petitioner, on merits and in accordance with law and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

The writ petition is disposed of accordingly. No costs.
