Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Prohibition to prohibit the respondents 1 to 3 from laying road on the water course comprised in resurvey No.155/7 of Rani Mookanoor Village, Pappi Reddy Patty Taluk, by dropping all proceedings. The petitioner's apprehension is that the respondents 1 to 3 are attempting to lay a road in the survey No. 155/7 of Rani Mookanoor Village, Pappi Reddy Patty Taluk, Dharmapuri District and hence has sought for a direction to prohibit from laying such road.
2. Heard Mr.C.Johnson, learned counsel for the petitioner and Mrs.A.E.Rani Selvam, learned Additional Government Pleader for the respondents 1 to 3.
3. The learned Additional Government Pleader, on written instructions from the third respondent, would submit that a mud road was laid between the survey No.155/7 and pipes were also laid to facilitate free supply of water for irrigation and thereby the water course is not affected. The learned counsel for the petitioner would submit that if the free flow of https://hcservices.ecourts.gov.in/hcservices/
water in the water course in survey No.155/7 is not affected, the petitioner would be satisfied. He would further submit that the respondents have no intention to disturb or prevent the free flow of water in the water course.
4. In view of the submission made by the learned Additional Government Pleader and recording the same, the writ petition is closed.
No costs. Consequently, connected miscellaneous petitions are closed.
