ORDER

This criminal original petition has been filed under Section 528 of BNSS to set aside the order dated 18.02.2025 in Crl.MP.No.9 of 2025 in Crl.MP.No.6 of 2025 in Crl.M.P.No.2599 of 2024 in SC.No.191/2021 passed by the learned II Additional District and Sessions Judge, Tiruppur and modify the condition that the petitioner shall execute a bond for Rs.25,000/- with two sureties.

2. The petitioner who is facing prosecution for the offence under Section 302 of IPC was arrested on 17.11.2023. He was released on bail on 02.12.2024 on certain conditions. In the modification petition filed before the Sessions Court in Crl.M.P.No.9 of 2025, the Sessions Court, by the order dated 18.02.2025 had directed the petitioner to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for like sum.

3. The learned counsel for the petitioner submitted that since the petitioner is unable to offer two sureties worth Rs.25,000/- (Rupees Twenty Five Thousand only), he is still languishing in jail and hence the amount of the bail bond may be reduced.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is in custody from 17.11.2023.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record.

6. Though the petitioner was granted bail as early as on 02.12.2024, he is still languishing in jail as he is unable to comply with the conditions, though the

conditions were subsequently modified by the impugned order. Hence, this Court is inclined to modify the condition imposed on the petitioner by directing the petitioner to execute a bond for Rs.10,000/- with two sureties for like sum. The other conditions imposed by the learned II Additional District and Sessions Judge, Tiruppur shall remain unaltered.
