For Petitioner (in all C.R.Ps) : Mr.S.Sairaman C O M M O N O R D E R Challenging the docket orders passed in E.P.(SR).Nos.9266, 9267 & 9268 of 2015 in O.S.Nos.199, 198 & 204 of 2001 on the file of the Principal Sub Court, Villupuram, the Decree Holders have filed the above Civil Revision Petitions.
2.Pursuant to the decree passed in O.S.Nos.199, 198 & 204 of 2001, the revision petitioners filed Execution Petitions in E.P.(SR).Nos.9266, 9267 & 9268 of 2015. The Executing Court returned the papers raising a query with regard to the maintainability of the applications. Challenging these orders, the Decree Holders have filed the above Civil Revision Petitions. 3.On a perusal of the docket orders passed by the Executing Court, it is clear that the Decree Holders have approached this Court without representing the papers and making any submissions with regard to the maintainability of the petitions before the Executing Court. 4.In view of the same, I am of the considered view that the petitioners/Decree Holders can be given an opportunity to make their submissions with regard to the maintainability of the applications before the Principal Sub Court, Villupuram.
5.Accordingly, I give liberty to the revision petitioners/Decree Holders to make their submissions before the Principal Sub Court, Villupuram with regard to the maintainability of the Execution Petitions within one week from the date of receipt of a copy of this order. The Principal Sub Judge, Villupuram is directed to pass orders, on merits and in
accordance with law, with regard to the maintainability of the Execution Petitions after hearing the submissions made by the learned counsel for the Decree Holders.
6.With these observations, the Civil Revision Petitions are disposed of. No costs.
