ORDER

1. This Civil Revision Petition has been filed, to direct the Principal Sub Court, Tirupur, to dispose of IA.No.1190 of 2014 in OS.No.40 of 2008.

2. This court heard the learned counsel for the Petitioner.

3. The learned counsel for the Petitioner has submitted that the suit is for specific performance of the suit sale agreement, dated 4.1.2006 and the said suit was dismissed for default. Subsequently, IA.No.1190 of 2014 for restoration under Order 9 Rule 9 of CPC along with Section 5 application to condone the delay of 976 days has been filed and the matter is still pending.

4. Without prejudice to the contentions and rights of both the parties, the learned Principal Sub Judge, Tirupur, is hereby directed to dispose of the RMT.TEEKAA RAMAN, J.
