Respondent PRAYER: Criminal Miscellaneous Petition is filed under Section 482 of Criminal Procedure Code praying to modify the petitioner shall deposit a sum of Rs.10,000/- (Rupees ten thousand Only) as non refundable deposit to "The Commissioner, Salem Corporation (for the purpose of Amma Unnavagam)" to the condition imposed in Crl.O.P.No.14996 of 2020 dated 24.09.2020 instead of the petitioner shall deposit a sum of Rs.20,000/- (Rupees twenty thousand only) as non refundable deposit to "The Commissioner, Salem Corporation (for the purpose of Amma Unnavagam)" within fifteen days from the date of receipt of copy of this order. O R D E R
(The case has been heard through video conference) This petition has been filed to modify the petitioner shall deposit a sum of Rs.10,000/- (Rupees ten thousand Only) as non refundable deposit to "The Commissioner, Salem Corporation (for the purpose of Amma Unnavagam)" to the condition imposed in Crl.O.P.No.14996 of 2020 dated 24.09.2020 instead of the petitioner shall deposit a sum of Rs.20,000/- (Rupees twenty thousand only) as non refundable deposit to "The Commissioner, Salem Corporation (for the purpose of Amma Unnavagam)" within fifteen days from the date of receipt of copy of this order.
2.The learned counsel for the petitioner submitted that this Court had granted anticipatory bail to the petitioner in Crl.O.P.No.14996 of 2020 dated 24.09.2020 with some conditions. However, due to the Corona Pandemic situation, the petitioner could not comply with the condition within stipulated period.
3. Heard both sides.
4. Considering the facts and circumstances of the case, this condition is modified to that effect that the petitioner shall deposit a sum of Rs.10,000/- (Rupees ten thousand Only) as non refundable deposit to "The Commissioner, Salem Corporation (for the purpose of Amma Unnavagam)" and two weeks time is granted to the petitioner to surrender and execute the sureties as ordered by this Court, from the date on which the order copy made ready. Failing which, the petition for anticipatory bail shall stand automatically dismissed.
