Prayer: Criminal Original Petition filed under Section 438 of Criminal Procedure Code, praying to enlarge the petitioner on bail in the event of his arrest in Crime No.3 of 2020 on the file of the respondent police.

ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 120B and 420 of IPC in Crime No.3 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The petitioner had earlier filed a petition in Crl.O.P No.14307 of 2020. Mr.Vinoth Kumar, learned counsel had appeared for the petitioner in the earlier petition. When the petition came up for hearing on 28.09.2020, this Court was not inclined to grant bail to the petitioner and therefore, the learned counsel for the petitioner sought permission of this Court to withdraw the petition and accordingly, the said petition was dismissed as withdrawn. Suppressing the earlier dismissal order, the petitioner has filed the present petition. When this Court informed about the earlier dismissal, the learned counsel for the petitioner sought permission of this Court to withdraw this petition.

3. It is reported by the learned Additional Public Prosecutor that it is a case, where the petitioner along with other accused have cheated 75 victims under the guise of constructing houses and the total amount cheated is more than Rs.1 crore and above.

4. Taking into consideration the nature of the allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed.
