ORDER
This Application has been filed by the petitioner to grant an interim custody of the minor child viz., K.Nayanika born on 29.05.2018 to the applicant herein every Saturday and Sunday from 9.00 am to 5.00 pm pending disposal of the Original Petition.
2.The case of the petitioner is that he got married the respondent on 15.01.2016 at Angalamman Temple, Annampakkam Village, Tindivanam, the said marriage was love marriage and the same was not registered. Out of their wedlock, one baby girl viz., Nyanika was born on 29.05.2018 at Kilpauk Medical College and Hospital. Both the parents did not agree the said marriage was solemnized between the petitioner and the respondent due to different communities. Thereafter, there was some difference of opinion between the petitioner and the respondent. Now, the respondent along with her minor child are residing in the parents house of the respondent. Hence this petition.
3.After filing of the Original Petition, this Court had passed an interim order dated 01.04.2025 permitting the applicant/father to visit the minor child viz., Nayanika, on every first and third Saturdays between 3.00 pm and 5.00 pm before the Child Care Centre attached to the Family Court, Chennai. Thereafter, the applicant/father represented that even after the interim order was passed by this Court on 01.04.2025, the respondent/mother failed to produce the minor child and thereby made a representation before this Court.
4.Today, both the learned Counsels are present. 5.The learned Counsel on either side submitted that the earlier order passed by this Court on 01.04.2025 has been complied with by the respondent/mother without any deviation.
6.In view of the above submissions made by the learned Counsel on either side, this petition is closed. No costs. 04.09.2025 MSM
