This application has been filed to set aside the exparte order dated 30.01.2024 in the above suit.

2. Learned counsel for the applicants has submitted that the case is at the stage of cross- examination of PW1 and he sought one more opportunity to contest the case.

3. Learned counsel for the respondents has vehemently opposed to allow this application since there is due of payment of huge amount by the applicants.

4. Having satisfied with the reasons stated in the affidavit filed in support of this application, this Court is inclined to allow this application by imposing cost.

5. Accordingly, this application is allowed on condition that the applicants pays a sum of Rs.10,000/- (Rupees Ten Thousand only) to the learned counsel for the respondents on or before 19.08.2024. In the event of failure on the part of the applicants in paying the said amount within the stipulated time, this application shall stand dismissed automatically without any further reference to this Court. https://www.mhc.tn.gov.in/judis
