C.M.P.No.13083 of 2020 in S.A.No.1352 of 1997 C.V.KARTHIKEYAN,J.

Though my Predecessor has directed notice in the present Application, having examined the averments made in the affidavit, I would rather allow that application since it is application filed to condone delay in representing C.M.P.SR.Nos.25870 of 2013 & 25872 of 2013.

2. The delay is condoned and I would rather hear the respondents in the main appeal. I am also informed that the Second Appeal itself has been dismissed, so learned counsel for the appellant shall take steps to restore the appeal. It is also informed that R.3 died and applications have to be filed to bring on record the legal heirs of R.3.

3.Registry may number C.M.P.SR.Nos.25870 & 25872 of 2013, if they are otherwise in order.
