O R D E R

The petitioner has come forward with this petition to direct the 2nd respondent police to register a case based on the complaint of the petitioner dated 23.12.2014 and investigate the same in accordance with law.

2.Heard the learned counsel appearing for the petitioner, learned counsel for the Intervenor and the learned Additional Public Prosecutor appearing for the respondents and perused the materials placed on record.

3. The case of the petitioner is that the proposed accused was conducting un-authorised chit and duped the petitioner to the tune of Rs.18,00,000/- and similarly there are other persons, whom the proposed accused had cheated.

4. It is seen that the respondent-police appear to have conducted perfunctory enquiry and closed the investigation on 03.02.2015.

5. Admittedly, the proposed accused is the wife of SSI of Police and this Court is of the view that the respondent police have not conducted the enquiry properly and the fact that it discloses cognizable offence, this Court directs the 2nd respondent police to register a case and take action under the supervision of the Assistant Commissioner of Police in accordance with law. Since the earlier compliant has been closed, this Court directs the petitioner to give a fresh copy of the previous complaint to the respondent police to register a case.
