ORDER

Seeking a direction to the second respondent police not to harass the petitioner except due process of law, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that this petitioner had availed vehicle loan from the defacto complainant. Thereafter, he has changed his address without intimating the finance company. The petitioner has also not paid the dues towards the vehicle loan. Therefore, the defacto complainant has filed the present complaint. On the complaint given by the defacto complainant, the petition enquiry is pending. Hence, the petitioner has filed this petition with the aforesaid prayer.

4. In my considered opinion, no blanket direction as prayed for by the petitioner could be given. If the petitioner is wanted either for enquiry or for interrogation, he can very well be summoned by the second respondent police and while doing so, the petitioner https://hcservices.ecourts.gov.in/hcservices/

shall not be harassed. At the same time, the petitioner should submit himself to the second respondent for interrogation and enquiry.

5. With the above observation, the Criminal Original Petition is disposed of.
