Mr. LSM.Hasan Fizal, learned Additional Government Pleader accepts notice for the R1 and R2 and is armed with instructions to enble a final disposal of this Writ Petition, even at the stage of admission.
2. No notice has been issued to R3 in light of the fact that its interests have been duly taken note of and addressed by virtue of this order.
3. The petitioner claims to be a member in the Thiruchengodu Rig Urimaiyalargal Sangam/represented by the Secretary, being R3 (in short 'Sangam'). He also claims to be a member of South Zone Agricultural Rig Owners' Association (in short 'South Zone Association') from 2014 to streamline the affairs of Rig owners in South India.
4. According to him, there had been some false representations made by R3 to the South Zone Association. In the course of enquiry, the petitioner and other members had been removed from their posts in R3 Sangam with which he is aggrieved.
5. According to the petitioner, he had conveyed to R3 that he is no longer a member of the South Zone Association, having resigned from membership on 10.07.2023. The resignation had been accepted by the South Zone Association on 04.08.2023. He claims to have made a requisition before 2/4
R3 Sangam and R1 has directed R2 to conduct an enquiry and take necessary action on the representation of the petitioner. He is aggrieved by the inaction of R2 and hence this Writ Petition.
6. The admitted position is that R1 has directed R2 to look into the matter and take necessary action as early as on 27.12.2023. Let R2 issue notice to the petitioner as well as to R3, hear both parties and pass orders in the matter in accordance with law bearing in mind the applicable rules and regulations as well as the bye laws of R3 Sangam, within a period of six (6) weeks from date of personal hearing of both parties.
