It is submitted by the learned counsel for the appellant that the cost has been paid in compliance with the order passed by this Court vide order dated 28.08.2023.

He has also filed a memo to that effect.

2.In view of the above, the memo is recorded and the miscellaneous petition is ordered, thereby, the delay of 363 days in filing the above CMA is condoned.

3.The Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list the same in due course.
