ORDER
This Criminal Original Petition has been filed to call for the records in Crime No.18 of 2021 pending on the file of the 1st respondent police and quash the same.
2. Heard the learned counsel for the petitioners, the learned counsel for the second respondent and the learned Government Advocate (Crl side) appearing for the 1st respondent police. 3.Today, when the matter is taken up for hearing, both parties along with their respective counsel have appeared before this court. Further, Affidavit has been filed by the defacto complainant/second respondent and the 1st petitioner before this Court. As per the affidavit, the petitioner stated that he would maintained his wife and child. The said affidavit was accepted by the defacto complainant /second respondent, so also the defacto complainant is inclined to live with the petitioner. Further, the second respondent is not inclined to proceed with 2/4
the case in Crime No.18 of 2021. This Court also enquired both the parties and satisfied that the parties have come to an amicable settlement between themselves before this Court.
4. Considering the affidavit filed by both parties, this Criminal Original Petition stands allowed and the proceedings in Crime No.18 of 2021 on the file of the 1st respondent police, is quashed and the affidavit has been filed in the typed set of papers along with this petition, shall form part and parcel of this order. Consequently, connected miscellaneous petition is closed. No costs. If any default committed by the 1st petitioner, the case will be opened and suitable orders will be passed.
