O R D E R

The petitioner has filed this petition to direct the respondent herein to consider and pass orders on the petitioner's application dated 26.12.2024 for the grant of Contract Carriage Maxi cab permit in respect of vehicle number TN-22/BL-6823, forthwith.

2. The petitioner, a driver by profession, purchased a second-hand Page No.1 of 4

maxi cab vehicle bearing registration number TN-22/BL-6823 in December 2024 and applied for a fresh contract carriage permit on 26.12.2024 by paying the prescribed fee. Despite submitting all necessary documents and reminders, the respondent has failed to issue the permit, leaving the petitioner unable to operate the vehicle and financially burdened due to ongoing payments to the financier. Citing the respondent's inaction as a violation of statutory duties under Section 80(1) of the Motor Vehicles Act, 1988 and Rule 136 of the Tamil Nadu Motor Vehicles Rules, 1989, the petitioner has filed this Writ Petition.

Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the respondent to consider the petitioner's representation dated 26.12.2024 on merits and in accordance with law, within a time frame to be fixed by this Court.

4. Learned Government Advocate appearing for the respondent has no objection for the said order being passed by this Court.

5. Heard the learned counsel on either side and perused the materials Page No.2 of 4

available on record.

6. Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs respondent to consider the petitioner's application dated 26.12.2024 on merits, in accordance with law and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

7. With the aforesaid observation and direction, this writ petition is disposed of. No costs.
