PRAYER: Writ Petition filed under Article 226 of Constitution of India, for issuance of Writ of Mandamus, directing the first respondent to calculate the interest as admissible under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013 and disburse the same in favour of the petitioner in respect of the acquisition of land in Survey No.566 measuring an extent of 600 sq. ft, Manapakkam Village, Alandur Taluk, Kanchipuram District.

O R D E R

This writ petition has been filed for a direction to the first respondent to calculate the interest as admissible under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013 and disburse the same in favour of the petitioner in respect of the acquisition of land in Survey No.566 measuring an extent of 600 sq. ft, Manapakkam Village, Alandur Taluk, Kanchipuram District.

The brief facts of the case is as follows:- The petitioner's land was acquired by the respondents for the purpose of Chennai Airport Expansion Scheme under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, on 14.06.2017 based on the Notification was issued on 16.12.2007 and an award was passed only on 16.03.2020, resulting unreasonable delay of 17 years from the date of preliminary notification. The compensation amount was fixed at Rs.100/- per sq.ft. in the year 2004-2007. Now, the market value of the land is between Rs.6000/- and Rs.10,000/- per sq.ft. Therefore, he filed a petition seeking enhancement of compensation before the learned Principal District Judge, Chengalpattu, which is also pending. Therefore, the petitioner submitted a representation dated 14.02.2025, requesting for calculation and disbursement of interest component and the same was not considered till date. Hence, this petition is filed for the above relief.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents 1 to 5.

4. Taking into consideration, the submissions made on either side

and without going into the merits of the case, a direction is issued to the first respondent to consider the representation of the petitioner dated 14.02.2025 and pass orders, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observation with regard to the merits of the petitioner's claim.

5. With the above direction, this Writ Petition is disposed of. No costs.
