Prayer: This petition is filed under article 226 of the Constitution of India to issue a writ of Mandamus directing the Respondent herein to receive the application of the petitioner dated 14.05.2024 in Form CCPA along with the prescribed fee paid by the petitioner through online for the grant of Auto rickshaw permit to operate the vehicle within radius of 30 k.m distance from Salem Town Bus stand, Salem and to consider the same and pass orders.

ORDER

This petition is filed to seeking to issue a writ of Mandamus directing the Respondent herein to receive the application of the petitioner dated 14.05.2024 in Form CCPA along with the prescribed fee paid by the petitioner through online for the grant of Auto rickshaw permit to operate the vehicle within radius of 30 k.m distance from Salem Town Bus stand, Salem and to consider the same and pass orders. 2.The facts of the case is that the petitioner is a auto rickshaw driver and he has applied for permit through online for the grant of the auto rickshaw permit to operate the vehicle within 30 k.m radius distance from Salem Town Bus stand.

It was to the shock and surprise to the petitioner that the respondent herein has refused to grant permit and when the same was questioned by the petitioner the respondent orally informed that they have received instructions from the office of the Transport Commissioner, State Transport Authority, Chepauk, Chennai-5 not to grant any fresh permits for Auto rickshaws.

3. The learned counsel for the petitioner submitted that the respondent are refusing to receive the application, due to which the petitioner was put to great serious inconvenience and hardship. Hence, prays to allow this petition.

4.The learned Government Advocate appearing for the Respondents submitted they will consider the case of the petitioner and take action in the manner known to law.

5. For the foregoing reasons this Court directs the respondent to receive the application of the petitioner dated 14.05.2024 in Form CCPA along with the prescribed fee for grant of Auto Rickshaw permit and consider the same on its own merits and in accordance with law and pass orders within period of eight weeks from the date of receipt of a copy of this order.

6. With the aforesaid direction, this writ petition is disposed of. No 3/5

order as to costs.
