Prayer: This petition is filed under article 226 of the Constitution of India to issue a writ of Mandamus directing the Respondent herein to receive the application of the petitioner dated 14.05.2024 in Form CCPA along with the prescribed fee paid by the petitioner through online for the grant of Auto rickshaw permit to operate the vehicle within radius of 30 k.m distance from Salem Town Old Bus stand, Salem and to consider the same and pass orders.

ORDER

This petition is filed to seeking to issue a writ of Mandamus directing the Respondent herein to receive the application of the petitioner dated 14.05.2024 in Form CCPA along with the prescribed fee paid by the petitioner through online for the grant of Auto rickshaw permit to operate the vehicle within radius of 30 k.m distance from Salem Town Old Bus stand, Salem and to consider the same and pass orders. 2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondent.

3. The issue involved in the present Writ Petition was dealt within the earlier Writ Petition in W.P.No.9394 of 2024 dated 10.04.2024.This Court after considering the earlier passed in this regard, issued direction to the concerned Regional Transport Officer. Similar orders can also be issued in the present case, since, the said order will ensure to the benefit of the petitioner also.

4. In the result, this Writ Petition is disposed of with a direction to 2/4

the respondent to receive the application of the petitioner dated 14.05.2024 in form CCPA along with the prescribed fee paid by the petitioner through online for the grant of Auto rickshaw permit and consider the same on its own merits and in accordance with law and pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. No costs.
