Writ petitions have been filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the 1st Respondent to consider the representations of the petitioners, dt.09.09.2014 and 2.11.2014 respectively and to dispose the same.

O R D E R

The petitioners have made representation, dated 9.9.2014 and 2.11.2014 to the first respondent seeking creation of pathway to reach their residence. On the said request, the second respondent has conducted an enquiry and in pursuant to the same, it was stated that only on the petitioner producing relevant documents such as parent documents, encumbrance certificate, appropriate action would be taken.

2 The learned counsel for the petitioner submitted that the grievance of the petitioners is that creation of pathway to reach his house.

Therefore, the second respondent has misdirected the same by treating the request made as one for change of patta.

3 This Court is not willing to go into the issues on fact. Petitioner ought to have approached the second respondent instead of the first respondent at the first instance. Be that as it may. Liberty is given to the petitioners to give fresh representations to the respondent No.2 seeking creation of the road to reach their houses. On such request being made, the second respondent shall pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. It is well open to the respondent No.2 to seek documents as he requires from the petitioners which the petitioners are duty bound to supply.
