Criminal Original Petition is filed under Section 528 BNSS to direct the Learned Special Court for Trial of Cases under SC ST POA Act, Thiruvarur in Spl.SC.No.8 of 2026 in connection Crime No.6 of 2026 to accept the surrender petition filed by the petitioner and on the same day and consider the bail application in Spl.SC.No.8 of 2026 pending on the file of Learned Special Court for Trial of Cases under SC ST POA Act, Thiruvarur in connection Crime No.26 of 2026 on the file of 2nd respondent.

ORDER
The petitioners have filed this petition seeking direction to the learned Special Court for Trial of Cases under SC ST POA Act, Thiruvarur in Spl.SC.No.8 of 2026 in connection Crime No.6 of 2026 to accept the surrender petition filed by the petitioners and on the same day and consider the bail application.
2. The dispute between the petitioners and the de facto complainant is that when the de facto complainant went to a tea shop and enquired about the price of food items, there was a wordy quarrel between the petitioners and the de facto complainant and the petitioners are said to have threatened and abused the de facto complainant by using abusive words and his caste name.
3. The learned Additional Public Prosecutor appearing for R1 and R2 submits that in this case investigation is completed and charge sheet has been filed in Spl.S.C.No.8 of 2026.
4. In view of the above factual position, there shall be a direction to the Special Court for Trial of Cases under SC ST POA Act, Thiruvarur, to consider the petitioner's bail application, preferably on the same day of his surrender, in Spl.SC.No.8 of 2026 in connection to Crime No.6 of 2026 and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of receipt of a copy of this order. 5.Accordingly, the Criminal Original Petition stands disposed. 28-04-2026 Index: Yes/No Speaking/Non-speaking order BKN
