2. In the affidavit filed, it had been stated that the summons copy had been misplaced and could not be traced within the time stipulated for filing written statement and there has been a delay in giving instructions to the learned counsel.

3. Taking into consideration the nature of the reasons advanced, the application stands allowed and delay in filing the written statement is condoned.

4. Registry may take on record the written statement filed on behalf of the defendant.
